SCOPE OF

The general terms and conditions of service listed here (hereinafter CGS) apply to all orders and purchases of products (hereinafter Products) made on the website www.eligoitalia.com (hereinafter Website) managed by ELIGO ITALIA, company under Swiss law (hereinafter: "ELIGO ITALIA") by persons residing in countries where the Website is active (hereinafter: Customer).

WARNINGS

The Customer is required to carefully read the GTCs before executing the purchase order.
By accepting the GTC and sending an order, the Customer declares:
that I have read, understood and accepted in full and without reservations the GCS of being a consumer and wanting to purchase the Products exclusively for personal use and not to resell them as part of a commercial or business activity, of any kind; to authorize ELIGO ITALIA to store, process, use and transfer the (personal) data contained in the order to third parties and / or abroad in order to perform the same.

ELIGO ITALIA endeavors to ensure that the information contained on the Website is accurate and updated. However, no guarantees can be offered in this regard. The Customer acknowledges and accepts that the Products may not fully comply with the indications, specifications and / or photographs on the Website.

ORDERS

The sales contract between ELIGO ITALIA and the Customer is to be considered finalized by sending the Customer, to the e-mail address indicated by the latter with the purchase order, of the written confirmation of the shipment.
ELIGO ITALIA will consider any requests for cancellation of the order received by ELIGO ITALIA before shipping the Products to the customer.
In the event that a certain Product present in the Customer's order is no longer available, ELIGO ITALIA will have no obligation to supply the Product in question, but will only be required to promptly inform the Customer of this circumstance. If only a part of the Products indicated in the order are available, ELIGO ITALIA will contact the Customer to ask him if he intends to cancel the order or is willing to receive only the Products available; in this case, the Customer will only be charged for the amount relating to the Products he will receive.
ELIGO ITALIA reserves the right to reduce, at its own discretion, the quantity of Products that can be purchased on the Website.

PRICES

The prices of the Products, expressed in Euros, will in any case be those indicated in the invoice. ELIGO ITALIA will however do its best to ensure that the prices indicated on the website are correct and updated.
Shipping and delivery costs may vary depending on the country and will be charged to the Customer at the time of shipment of the Products ordered, based on the shipping rates in force indicated in the relevant section of the website.
Payment will be made by the Customer upon confirmation of shipment by credit card or in the other methods indicated in the relevant section of the Website.

DELIVERY

The delivery of the Products will be made to the delivery address indicated by the Customer in the order.
In principle, the Products will be delivered within 30 (thirty) days of order confirmation by ELIGO ITALIA, it being understood that delivery times may vary depending on the country of destination. In the event that the delivery is delayed for reasons not attributable to ELIGO ITALIA, the Customer will be notified, as far as possible, of the new delivery date.
ELIGO ITALIA reserves the right to refuse, suspend or cancel, at its own discretion, the delivery or fulfillment of any of the obligations deriving from the sales contract in the event of alleged fraud, default or breach by the Customer of obligations assumed towards ELIGO ITALIA with previous orders and / or sales contracts. If the Products ordered require the crossing of customs (based on the country of destination) and the Customer decides not to receive the order once it has arrived at customs, ELIGO ITALIA will not grant a refund for the goods which will be abandoned on the spot.

RIGHT OF WITHDRAWAL

The Customer has the right to return the Products purchased on www.eligoitalia.com, without any penalty and without being required to give reasons, within fourteen (14) calendar days starting from the day of receipt by the Customer. of the Products in question, respectively within the deadline set by the mandatory rules applicable in the country where the Customer resides, if this is longer.
With the receipt of the Products by ELIGO ITALIA, the sales contract will be considered canceled for all purposes and all related obligations, rights or claims will lapse, it being understood that if the Products returned to ELIGO ITALIA are damaged, ELIGO ITALIA will have the the right to compensate for this damage with the payment of the Products already made by the Customer.
In addition to the above (articles 15-16), the right of withdrawal is subject to the following conditions:
Within fourteen (14) calendar days from the date of receipt of the Products by the Customer. the Customer must contact ELIGO ITALIA customer service by sending an e-mail to info@eligoitalia.com in order to obtain authorization to proceed with the return ("RMA");
After receiving the RMA, the Products must be returned to ELIGO ITALIA, at the risk and expense of the customer, with a single shipment by courier or registered mail within 2 (two) days from the date of receipt of the RMA to the communicated address. . It is required to clearly indicate on the return package both the ELIGO ITALIA recipient and the RMA code, in order to avoid loss; in case of non-delivery of the returned package, ELIGO ITALIA will ask the customer for proof of delivery, or the slip bearing the signature of the person who received the returned package. If the customer does not provide proof of delivery, ELIGO ITALIA will not be able to grant the refund.
The Product being returned must not have been used, consumed, or damaged;
The Product must be returned in its original packaging, with any accessories;
As soon as it is able to confirm that the required conditions have been met, ELIGO ITALIA will send the Customer an e-mail confirming the acceptance of the return and will start the refund procedure so that the Customer receives a refund of the amount paid for the Products returned within the following thirty (30) days, regardless of the payment method previously adopted by the Customer. The refund of the amounts paid by the Customer will always be made exclusively in favor of the Customer who made the payment.
In the event that the above conditions have not been respected, the Customer will not be entitled to a refund of the amount paid to ELIGO ITALIA.

WARRANTY AND LIMITATION OF LIABILITY

ELIGO ITALIA's warranty is limited to any manifest defects in the Products - excluding, without limitation, any implicit guarantee regarding the quality and fitness for purpose for the Customer - for a period of 1 (one) year from delivery of the Products.
The guarantee only gives the right to obtain a refund of the amount paid for the defective Products, provided that the defect is communicated to ELIGO ITALIA within 2 (two) months from when it was found, excluding normal wear and tear of the materials.
Without prejudice to the aforementioned guarantee, ELIGO ITALIA excludes any and all liability (contractual or extra-contractual) towards the Customer, within the limits of the applicable mandatory rules.
The maximum limit of overall liability borne by ELIGO ITALIA may in no case exceed the amount paid by the Customer for the purchase of the Product.

GENERAL PROVISIONS

In the event that one or more provisions of these GCS should be null, voidable, illegal or ineffective, this will not result in the total ineffectiveness of the GCS. The provision in question will be replaced by a similar valid provision that duly takes into account the intention and content thereof, in compliance with and pursuant to the regulations in force.
These GTCs are subject to Swiss substantive law (excluding Swiss law on private international law and international treaties, in particular the United Nations Convention on Contracts for the International Sale of Goods).
Any disputes that may arise will be referred to the exclusive jurisdiction of the competent court of Zug (Switzerland).
 

SHIPMENTS

WHEN IS MY ORDER SHIPPED?
Orders placed during office hours (Monday to Friday, from 8:00 to 17:00) will be processed on the same day and delivery follows the timing of the country of reference. Deliveries are not made on Saturdays and Sundays and on holidays, therefore they are made on the next working day.

IS THE DATE OF THE ORDER DIFFERENT FROM THE SHIPPING DATE?
The order date refers to the time when the order was placed and confirmed on the site, otherwise, the shipping date refers to the time when the goods leave our warehouse and are taken over by the courier.

HOW CAN I PAY?
It is possible to pay by credit card (Visa, Mastercard, American Express)

WHEN DOES MY ACCOUNT BE DEBITED?
Your account will be charged when you receive the order shipment confirmation email. Therefore the amount is debited from the current account at the time of the actual shipment of the goods, which can also take place a few days after the order confirmation.

WHAT MONETARY CURRENCY IS USED?
In all member countries of the European Community the currency used is the Euro (EUR)

ARE ONLINE PURCHASES SAFE?
www.eligoitalia.com uses specific systems for the control and verification of all transactions that take place through the site, such as the Secure Sockets Layer (SSL) to allow the encryption of potentially sensitive information.

WHY HAS MY PAYMENT NOT BEEN ACCEPTED?
The reasons for non-acceptance of payment can be different: try to check the card details entered during the order, such as the expiry date, the type and the card number. If the problem persists, please contact our Customer Service.

WHAT IS THE CVV / CVC CODE?
The CCV code (Credit Card Verification or CVC Card Verification Code) is a 3 or 4-digit number shown on the credit card and required to increase the security of the operation.

RETURNS AND REFUNDS

CAN I CHANGE AN ITEM?
If your order has been shipped, please wait to receive it and then contact our Customer Service to request a return. We remind you that once the confirmation has been made, the order can no longer be canceled.

HOW CAN I RETURN AN ITEM?
It is necessary to contact our Customer Service to have the return authorization created before returning the product to us.
